The Telangana High Court on Thursday gave a major reprieve in the controversial Kaleshwaram project case. It ruled that no proceedings can be initiated solely on the Ghose Commission report, which had flagged alleged irregularities and accused senior IAS officer Smitha Sabharwal of playing a key role.
The report cited her site visits, feedback to then CM KCR, and alleged lapses in placing files before the Cabinet. But Sabharwal argued she had no role in decision-making and that the Commission violated Sections 8-B and 8-C of the Commissions of Inquiry Act by not giving her a fair hearing.
The division bench led by Chief Justice Aparesh Kumar Singh agreed, calling the findings “unfair” and “prejudicial.” For now, the officer walks free from action in a case that has become a political flashpoint in Telangana.
